When requesting an unemployment benefit (whether it is unemployment or any of the subsidies), the citizen’s greatest concern is to know if they are entitled to help and, if so, when they can receive it in their bank account. The body that, if the applicant has submitted his request correctly and with all the necessary documentation, has 15 days to answer the citizen’s request and have a resolution prepared announcing whether the benefit is approved or rejected .
From the moment in which said resolution takes place, the SEPE subsequently has 10 days to send the applicant what the resolution has been. The communication must be made to the address provided by the citizen, who could also receive it at the email or mobile phone number (via SMS) provided in the request for the benefit.
However, it may happen that, for whatever reason, the communication to the citizen is not carried out or is lost along the way. The SEPE explains that if three months have passed since the application for unemployment benefits has been sent and a response has not been received, it will be understood as denied due to administrative silence.
What to do if you are denied unemployment benefits
At that time or when they receive a resolution rejecting the payment of the benefit, the citizen may launch a prior claim letter addressed to the SEPE, either by sending a certified letter or at the agency’s offices, although for this they must request an appointment advance (both online and by phone). The term to do so is 30 days from the resolution or from the administrative silence.
Once the previous claim has been made, the citizen has to wait. If he receives a response from SEPE and it is negative, he may take legal action, filing a lawsuit in the Social Court. If he does not receive it, he may file a lawsuit after 45 days of silence from the institution.
