Restalia franchisees ask the judge to also investigate Heineken

Restalia franchisees and complainants of the ‘100 Montaditos case’ demand that Heineken be investigated in the proceeding of alleged fraud, criminal organization, coercion and computer crimes against 29 companies linked to the Restalia Group, including La Sureña and The Good Burger.

The brewery has confirmed that it has a contract with Restalia to be an approved supplier, however the company claims to be “unrelated to the contractual relationship between Restalia and its franchisees”, so “it does not have access to any type of information regarding the conditions , rights or obligations that may exist between the two, for which he is absolutely unaware of the conditions agreed upon between them”.

Thus, they made the project “unfeasible”. In this way, the group caused a loss of around 20 million euros to the first 32 franchisees, that is, the average damage per franchisee ranges between 300,000 euros and 600,000 euros.

What happened in June

During the press conference held last June, but before the testimonies of the franchisees, they had to investigate the facts reported by the allegedly affected. For this reason, the lawyers endorsed that there is an “initial conduct of indiscriminate recruitment of franchisees with promises of profitability.”

From the Cremades & Calvo-Sotelo and Rafael Franco Lawyers offices they insisted that the franchisees were given a business plan with “unrealistic numbers” that led to the signing of the contracts

In addition to directing the case against 29 merchants linked to Restalia, proceedings were also initiated against the owner of the Group, José María Fernández Capitán, and another twenty managers at different levels in the companies of the conglomerate.
