Of the more than 743,000 unemployment benefits that are paid each month in Spain, one of the most important is the one for workers over 52 years of age, a benefit that has undergone a recent modification by which the number of its beneficiaries will increase.
The Council of Ministers approved this Tuesday a modification of the consolidated text of the General Law of Social Security to equalize access to unemployment subsidy for those over 52 years of permanent discontinuous workers, who until now could not receive this managed care benefit by the State Public Employment Service (SEPE).
The reference of the Council of Ministers this Tuesday explains that discontinuous permanent workers “the access of this group to unemployment benefits under the same conditions and with the same rights that apply to other workers employed by others.”
The Government estimates that, immediately, up to 18,000 workers could benefit from this measure each month, although it is not ruled out that the figure may be later in the future. In fact, from the CCOO union it is pointed out that this figure will surely be higher due to the promotion of the transformation of temporary contracts by hiring discontinuous permanent workers.
The Executive’s measure does nothing more than comply with what was already established in the recent , the labor reform that called for completing “the necessary modifications to improve the protection of the fixed-discontinuous group” and thus guarantee access to the subsidy for over 52 years of age “under the same conditions and with the same rights that apply to other employees”.
What are the subsidy requirements for people over 52 years of age?
Thus, permanent-discontinuous workers may request the collection of this subsidy for those over 52 years of age as long as they meet the rest of the conditions imposed by the State Public Employment Service (SEPE), :
-Have the essential requirement of being at least 52 years old.

-Having exhausted the strike or unemployment subsidy, having contributed less than enough after receiving the strike, having improved from a permanent disability, having returned from prison (in sentences of at least six months) or having returned from abroad.

-Have the right to the contributory retirement pension except for the requirement of the .
-Prove income below 75% of the Minimum Interprofessional Salary (SMI), either in individual terms or by adding the income of all the members of the family unit and dividing by the number of members.
Amount and duration of the subsidy for people over 52 years of age
Like other unemployment benefits, the amount established for the subsidy for people over 52 years of age is 80% of the IPREM (Public Indicator of Income for Multiple Effects), to stand at 463.21 euros per month.
The duration of the subsidy for those over 52 years of age, however, does vary compared to the rest of the subsidies. The reason is that it can be collected until the ordinary retirement age, at which time the citizen would begin to collect his contributory retirement pension.
How much is quoted with the subsidy for people over 52 years of age
The SEPE explains that, as long as they receive the subsidy for those over 52 years of age, the beneficiaries will maintain their Social Security contributions for retirement. Specifically, the base for which they will contribute monthly will be 125% of the minimum contribution base in force at any given time.
