This is the degree of disability you need to collect a disability pension (and how it is calculated)

Although permanent disability pensions can overshadow them by reaching a greater number of people, the truth is that for all those people who have a certain level of disability and meet the rest of the requirements, they can choose to receive a non-contributory pension of disability.

As explained by , these pensions must be differentiated from those for permanent disability because there are several key differences between them. Disability pensions confirm a specific degree of disability of the pensioner, while permanent disability pensions compensate for the effects on the person’s work or daily life. In addition, those for disability are granted by the autonomous services of each community, while those for permanent disability depend on Social Security.

Having a disability does not imply, in any case, the collection of a disability pension. These pensions are set aside for people who can prove at least 65% disability. And to determine what a person’s disability is, the social services of the autonomous community in which they reside come into play.

The legal text of reference in these cases is the , of procedure for the recognition, declaration and qualification of the degree of disability, but in practice there are several factors that are detailed by the Campmany Abogados law firm.

The teams designated by each autonomous community will proceed to examine the ailment that affects the citizen, checking how it affects him in aspects such as self-care, his ability to communicate, his physical activity, the functioning of his senses, his use of the means of transport, their sexual function or the possible effects on their sleep, among others.
