How to collect unemployment benefits with a part-time job

The collection of an unemployment subsidy (in any of its modalities) obliges its beneficiary to meet certain requirements, which does not exempt him from being able to enjoy certain rights while collecting said aid. Like, for example, enjoying a part-time job in certain circumstances.

Unemployment benefits are compatible with receiving a salary for a part-time job. The key is not to fail to comply with the essential income requirement for the collection of the assistance benefit: not to exceed 75% of the Minimum Interprofessional Salary (SMI), an amount that is currently 723.75 euros per month.

As Clara Martínez, adviser to the General Subdirectorate of Benefits of SEPE (Public State Employment Service), has made clear in the newspaper, in these cases the proportional part of the day worked will be deducted from the subsidy. During that time, yes, you will spend the duration of the subsidy as if you were collecting it in its entirety.

Making the subsidy compatible with a part-time job means that if, for example, a person works 50% part-time, earning half the SMI (482.50 euros), the amount of their subsidy will be reduced by 50%, passing to be this of 231.60 euros per month. This would leave a total, combining allowance and salary, of 714.10 euros per month, an amount below the 75% SMI required.

There would be no problem in this case if the beneficiary of the subsidy were free of family charges or responsibilities, since they would fully meet that income requirement as they are the only person to be taken into account with regard to that income limit.

Things change when the beneficiary of the subsidy has family responsibilities, since it would be necessary to take into account all the income and those of the rest of the members of the family unit, divided in turn by the number of members that form it. That result must also be less than 75% of the SMI, since otherwise that income requirement would be met.

How will the rise in the SMI affect

It must be kept in mind that in a few weeks the Government will make the increase in the Minimum Interprofessional Wage effective, which will be retroactive from January 1, 2022.

This will cause the income limit of 75% of the SMI to be extended to 750 euros per month, so people who have incomes below that figure but who, with the current SMI, were above it should review their situation to find out if With the increase in the SMI, they could make some part-time work compatible, recommends Clara Martínez.

How to reconcile the subsidy with a part-time job

In order to collect the subsidy at the same time that this part-time job is available, the citizen must request the compatibility, since from the first day he starts working, the SEPE will suspend the subsidy that paid him. Depending on when he does it, the citizen will have the right to do it from the first moment or, on the contrary, it will take a little longer and he will lose a specific period of benefit:

-If you request compatibility in the first 15 days of work, the compatibility will be from the first day of work, so you will not lose any day of subsidy.

-If you request compatibility beyond that period of 15 days, the compatibility will start counting from the day of the request.

The procedure can be done through the pre-application form that the SEPE makes available at its Electronic Office, . To enter you must enter your DNI or NIE number and choose the reason for your request, which in this case will be ‘Pre-application for individual benefit’.

When you enter, you will have to choose the ‘Part-time work compatibility’ sub-process and fill in the rest of the fields: personal data (name, surname, ID expiration date, name and surname of the parents…), contact information (address, postal code, telephone number and email address) and direct debit details.
