The Community of Madrid agrees to the perimeter closure in San José and Easter but will appeal the measure to the courts

The Community of Madrid will apply the but will appeal to the Justice for not agreeing with the technical effectiveness of the measure and understanding that legally the Ministry of Health cannot impose it.

This has been advanced in the weekly press conference on the epidemiological and healthcare situation by covid-19 by the Deputy Minister of Public Health and Covid-19 Plan, Antonio Zapatero, who has indicated that this Thursday the communicated order was received from the Minister of Sanidad, Carolina Darias, approving the coordinated actions for the San José bridge and .

“The Community of Madrid will apply said communicated order,” said Zapatero, who has advanced that this Saturday a new decree will be published in the BOCM to apply the “imposed” perimeter closure between March 17 and 21 and between March and April 9.

However, Zapatero has announced that, “once the legal services have been consulted”, the regional government “will present an appeal before the Justice for not agreeing with the technical effectiveness of the measure and understanding that legally the Ministry of Health cannot impose an agreement of the Interterritorial Council that has not been adopted by consensus and that is not legally binding”.

In this sense, it has argued that “the intervention of the Interterritorial Council of the National Health System is limited to what is established in the Royal Decree of the declaration of the state of alarm, corresponding to the delegated competent authority, that is, to the president of the Community of Madrid, the adoption of the measures provided for therein.

In addition, he added that “a scientific justification is added to these legal justifications, and that is that it is technically proven that population density plays a determining factor in the greater transmission of all respiratory pathologies, and the coronavirus is one of them.”

Zapatero has pointed out that apart from this one published in various scientific journals, “it is a fact that has been corroborated in Madrid because when the perimeter closure of the Community of Madrid, a single province, has occurred, infections have increased, so we understand that from the pandemic in our community. “Even so, and as we have repeatedly insisted, the Community of Madrid will always scrupulously comply with the law,” he added.
