These are the tips to pass the medical court and get a permanent disability pension

When we apply for a permanent disability pension, one of the most important and dreaded parts of the process is going through the medical court that will inform Social Security if, in their opinion, we are worthy of that pension or not. A tense situation in which you never really know how to act.

In the first place, the person who submits to the judgment of the court must know that this body will not be in charge of deciding if he deserves a pension or not. and the final decision-making corresponds to Social Security. Of course, their opinions usually count and matter a lot. But the aspiring pensioner must relativize in this sense in order to contribute to his relaxation.

For the procedure itself, that ‘face to face’ with the court, the law firm specialized in issues of incapacity to face this test and not generate doubts in court.

According to the firm, “the key is to be natural and consistent.” It may seem trivial, but in the stress of the moment it is sometimes forgotten and it is especially important when the court begins to question the prospective pensioner. Many of them may hide a ‘trap’ that seeks to know the real degree of dependency or the affectation of the illness to family and/or work life.

Always remain calm and do not show anger or an adverse reaction to the court’s questions or requests, which may even require the plaintiff to make certain movements or actions. Obviously, lying is not an option, but neither is exaggerating about our state. Also, being defensive can be counterproductive, as there is a chance that it will increase the suspicions of the court.

Another piece of advice that must always be kept in mind is to have all the documentation and medical reports that are available, since they will be extremely important to prove the condition that the disability pension must guarantee us. Based on these reports, the court may request those movements or actions mentioned above. Hence, also, the need to respond willingly to these requests.

In summary, the firm explains that the perfect formula to successfully pass the court is “remain calm and, above all, be sincere”, rely on all the medical reports in our possession and act as naturally as possible.
