Almeida manages to approve his Sustainable Mobility ordinance thanks to four former councilors of Más Madrid

Since Monday, the city of Madrid has a new Sustainable Mobility ordinance after obtaining the majority of favorable votes in the Cibeles plenary session thanks to the ‘yes’ of the formations that make up the municipal government (PP and Cs), as well as the four positive votes of the newly created Mixed Group. Vox, the PSOE and Más Madrid have voted against.

In this way, Madrid will continue to have a low emission zone as established by the Climate Change Law for cities with more than 50,000 inhabitants -two in particular, one in the Center and another in Plaza Elíptica-. The regulatory framework is also established so that the entire territory of the capital becomes a Low Emission Zone (ZBE) progressively from next January 1, 2022.

This after the Supreme Court inadmissible last April the appeal filed by Ecologistas en Acción thus confirming the previous ruling of the TSJM in which it was due to formal defects.

This had been annulled after partially estimating the resources presented by the Community of Madrid, the Popular Group in the Madrid City Council and the company DVuelta Legal Assistance without going into the merits of the matter and without assessing the delimitation of this low emission zone and its regulation .

The ordinance will enter into force as of next week after being approved in plenary this Monday. The municipal government maintains that it will foreseeably be published before the ten-day period given to execute the sentence that settles Madrid Central.

Center and Elliptical Plaza

The Sustainable Mobility ordinance creates the figure of ZBE of Special Protection in the Center and Plaza Elíptica, which will have additional measures such as movement restriction, speed, creation of pedestrian zones. An element promoting the development of economic activity is incorporated by equating the treatment for residents and merchants who carry out their activity in the area.

The perimeter of Central Madrid will be the same as that of the new Low Emission Zone of the Central district and will enter into force the same day the new ordinance is published, except for the transitory provision for merchants to access, for which there is a period of three months.

Camera access control systems have a two-month notice. Despite this, you can be fined for improper access.

The Plaza Elíptica low emission zone will reduce traffic in the area by 18.6%, the equivalent of a decrease of 37,000 vehicles per kilometer per day, and will come into force three months after publication, that is, in December, and there will also be two months notice.

The Madrid City Council will send the residents of the Center and the merchants the new modifications with respect to the old Madrid Central. Although, the authorized license plates of neighbors will already be in the system.

The keys

With this new municipal regulation, the city will progressively have a large Low Emission Zone to improve air quality. The progressive restriction of circulation to the most polluting vehicles, those that do not have an environmental label (A), is contemplated through the creation of the Madrid Low Emission Zone (ZBE).

Its application is by territorial rings, making it possible to meet the limit values ​​and air quality thresholds established by community and state regulations on air quality and environmental protection.

As of January 1, 2022, access to and circulation on urban public roads inside the M-30 is prohibited, excluding the M-30 itself. As of January 1, 2023, access to and circulation on urban public roads inside the M-30 and the M-30 itself is prohibited.

Bicycles and scooters

Bicycles will be able to circulate through tunnels and Personal Mobility Vehicles (VMP) such as scooters will be able to do so through multimodal lanes – a lane with a speed limited to thirty kilometers per hour or less.

Scooters and other VMPs may travel through these multimodal lanes as long as they use an approved helmet and are illuminated as contemplated in the General Traffic Regulations.

In addition, three sections are included in the article to regulate the safety distance that motor vehicles must keep with respect to VMPs: five meters away if driving behind them, change lanes to overtake them and VMPs are allowed to use the roundabout lane they need to make themselves more predictable without the rest of the vehicles cutting their trajectory, which in turn have to slow down.

The prohibition on parking in the pedestrian area of ​​collective public transport stops and reservations for the parking of vehicles for people with reduced mobility and in areas with pedestrian access to waste collection containers is incorporated.

The speed for motor vehicles is limited to 20 km/h on urban roads that have a single roadway and sidewalk platform when there are separating elements between them (bollards) and 15 km/h when there are none. The speed of vehicles in school environments is also reduced to 20 km/h.

SER dynamic rate

The ordinance regulates the new dynamic rate of the Regulated Parking Service (SER). The new regulations put an end to articles 56 and 57 that regulated neighborhood parking areas, since they did not determine the specific system for their control and the SER formula is maintained for those neighborhoods where there are parking problems for the rational management of public space. .

The text contemplates the possible extension of the service in article 57 to 20 new neighborhoods partially (part of the territory) or totally. It would only be implemented upon local demand. Of the 49 neighborhoods that are currently governed by this formula, it would rise to 69.

The areas that are partially incorporated would be: Peñagrande (Fuencarral-El Pardo); Valdezarza (Moncloa-Aravaca); Los Cármenes and Puerta del Ángel (Latin); Gate of the Angel (Latin); Opanel, San Isidro (Carabanchel); Zofío and Pradolongo (Usera); Sales, Pueblo Nuevo, Quintana, Concepción, San Pascual, San Juan Bautista, Colina, Atalaya and Costillares (Linear City). The SER will be fully implemented in the neighborhoods of Comillas (Carabanchel); Almendrales and Moscardó (Usera).

Articles 229 and 230 introduce the requirement that vehicles used in the direct or indirect management of municipal services and in the execution of contracted services have ZERO, ECO and C vehicles.

The night bus will be launched on demand (article 41), and the extraordinary stop for the descent and, where appropriate, the rise of people who request it, may be authorized on certain bus lines. Also, after the amendment period, there will be a daytime on-demand bus in some areas of the capital.
