Government and social agents reach an agreement to extend the Erte until February 2022

The Government has reached an agreement in principle this Monday with the social agents to extend the protection scheme of the Erte until February 2022. Finally, just three days after its expiration, the more than 250,000 workers who are still under the umbrella of the temporary employment regulation files will continue with the labor protection umbrella at least until the beginning of next year, after an arduous negotiation at the social dialogue table.

In this way, the meeting of the table on the afternoon of Monday, September 27, reached the agreement pending ratification by the respective organizations that make up the table CEOE, CEPYME, CCOO and UGT. And that comes after a substantial improvement in conditions by the Executive. For tickets, the term of the Ertes is extended until February 28, 2022.

In addition, the counter is reset to zero until December 31, 2022. In other words, the unemployment time consumed, from September 2020 will not count when a dismissal occurs for any reason after January 1, 2023 (previously it was 1 January 2022).

Improved exemptions

Also in this last agreed text, the exemptions for companies with more than 10 workers are improved. These may have a 40% exemption in the event that training is not provided and 80% in the event that it is provided. For companies with up to 10 workers, a 50% exoneration is left if the training is not given and it rises to 80% in the event that the training actions are given.

In this sense, the extensions can be processed throughout the month of October, in which the validity and effects of the Royal Decree-Law of May will be maintained, so that the validity will begin in November 2021. And it is definitively fixed that administrative silence will be applied positively.

On the other hand, the benefits related to the unemployment benefit for workers are maintained, such as the maintenance of the protection conditions for workers with a permanent discontinuous contract -the 70% benefit is maintained throughout the term of the agreement- . And the commitment to maintain employment is also maintained, the prohibition to dismiss, the interruption of the calculation in temporary contracts, the prohibition of overtime and the impediment of making new hires in companies that are applying Ertes or the limit to outsourcing while enjoying the benefits of this extraordinary legislation.

Thus, 30 hours should be spent on training actions in companies with between 10 and 49 workers and 40 hours in employers with more than 50 employees. Likewise, training activities are linked to an increase in credit for financing in the field of programmed training, included in Law 30/2015, which regulates the professional training system for employment in the workplace.

Among the first reactions, from the CCOO they positively value the preliminary agreement reached this afternoon to renew the Erte. “We also value the effort of the Government to meet the demands that the CCOO has been raising in this negotiation process,” the union pointed out.

Also ensuring that the result is an agreement that significantly improves the conditions of the workers who are in Erte. “The validity is extended to five months, the counter is also extended by one year to zero and this is also extended to discontinuous permanent people who previously did not have it recognized”, they point out from CCOO.
