Entrepreneurs Law: everything you need to know

On March 29, 2017, Argentina sanctioned the known as the “Entrepreneurs Law”.

The main objective is to encourage entrepreneurial activity in the country and the increase in Argentine entrepreneurial capital.

With the implementation of this new legal regulation each idea can become a venture in a simple, agile and fast way, eliminating bureaucratic obstacles. Likewise, the regulation aims to encourage the economy and generate more employment Throughout the national territory.

It is the first law in the history of our country that directly addresses the problems of entrepreneurs by offering them a new favorable and encouraging ecosystem.

1) You can create your company in one day

Through a new legal figure, the (SAS) You have the possibility of creating your company in 24 hours in a simple, agile and digital way!

• Simple: because it includes the opening of a bank account, a new CUIT and a basic capital of two minimum wages, vital and mobile.

• Agile: because your company can be made up of a single partner, the object of your business can be broad (which will save you updating efforts if your project grows in the future) and the procedures are done on-line: signatures, books and powers are digital. Forget the papers!

⚠️ Update as of 8/28/2021: The National Senate approved on 6/11/2020 the bill that proposes the suspension for 180 days of the constitution and registration of Simplified Stock Companies (SAS). A year later, on June 10, 2021, the National Legislation Commission of the Chamber of Deputies analyzed the project and issued a majority opinion. .

Additionally, the Senate has on the agenda for the coming weeks to debate the reform of the law that created the Simplified Stock Companies. We will update this post as soon as the future of the SAS is defined.

2) You will have more financing for your ideas

• Investment funds: A FONDCE (Trust Fund for the Development of Entrepreneurial Capital) is created so that the State allocates public funds to co-invest with private parties and promote the development of projects.
• Crowdfunding: You can develop your project from an online collective financing network supervised by the National Securities Commission.
• Accelerators: 13 accelerators will be selected to help grow Argentine projects: 10 of them will be dedicated to technological and social ventures and 3 to scientific businesses.

3) Access new credits to start your business

If you are starting your own business, you will always have a 0% loan to help you grow.

In addition, the law provides tax benefits to investors who choose to support Argentine ideas: they will be able to deduct between 75% and 85% of the amount they contribute from the Income Tax, up to a limit of 10% of their annual earnings.
